SAMR Issues the Provisions on Trade Secret Protection


On February 24, 2026, SAMR issued the Provisions on Trade Secret Protection (the "Provisions"), effective June 1, 2026.,The Provisions systematically refine the trade secret provisions of the Anti-Unfair Competition Law, and simultaneously repeal the Several Provisions on Prohibiting Infringement of Trade Secrets. Key highlights include: 

1) Recognition of trade secrets and confidentiality measures: algorithms, data, code, and interim R&D results are explicitly within the scope of protection;,confidentiality standards for remote work and cross-border collaboration are introduced; 2) Recognition of infringing acts: typical electronic infringement acts are enumerated, such as unauthorized or excessive access to digital office systems, servers, email accounts, and cloud drives, and obtaining trade secrets through malicious programs or exploit attacks; 

3) Recognition of non-infringing acts: balancing talent mobility with trade secret protection;,five categories of non-infringing conduct are identified, including independent discovery or self-development, and use of general knowledge, skills, and industry experience accumulated during employment; 

4) Introduction of burden of proof shifting; reaffirmation of jurisdiction over overseas infringement: a burden-shifting mechanism is introduced in administrative proceedings; the identification of "serious circumstances" is further refined; and jurisdiction is reaffirmed for cases where overseas infringement disrupts domestic market order or harms legitimate rights of domestic operators.

CAC Issues the Measures for Classifying Online Information that May Affect the Physical and Mental Health of Minors and the Measures for Identifying Online Platform Service Providers with Large Numbers of Minor Users or Significant Influence over Minor Groups


From January to February 2026, the CAC successively issued the Classification Measures (hereinafter "Classification Measures") and the Identification Measures (hereinafter "The Identification Measures"), accelerating the development of implementing legislation for the Regulations on Online Protection of Minors. Specifically:

1) The Classification Measures primarily specify the types, scope, and identification criteria for online information that may affect the physical and mental health of minors, as well as the specific methods for prominently flagging such information when displayed. General online product and service providers must ensure that such information cannot be displayed in prominent positions or key areas likely to attract user attention; algorithmic recommendation and generative AI services must limit the push of such information to minors; and online products and services specifically targeting minors must prohibit such information.

2) The Identification Measures primarily align with Article 20 of the Regulations on Online Protection of Minors regarding enhanced obligations for platform service providers with large numbers of minor users or significant influence over minor groups. They specify numerical thresholds for identifying such heavily regulated platforms, factors for assessing "significant influence," and identification procedures. Platforms meeting the identification criteria are required to proactively apply for identification, while platforms that do not apply may also be notified to undergo identification following evaluation and deliberation.

SAMR Publishes Five Typical Cases of Unfair Competition in the AI Sector


On February 6, 2026, SAMR published five typical cases of unfair competition in the AI sector, aiming to guide the industry toward compliant operations and maintain fair competition order.

The published cases cover the main types of violations in the AI sector, including::

1) Commercial confusion: three of the five typical cases involved utilizing the popularity of well-known AI products (such as DeepSeek and ChatGPT) to commit imitation and free-riding as unfair competition. For example, some companies set up counterfeit websites, used similar icons and names, and under the guise of "DeepSeek local deployment tools" or "ChatGPT Chinese version," induced users to pay, gaining improper benefits.

2) False advertising: one company used its developed AI voice auto-dialing software to help loan intermediaries make mass automated calls using preset false scripts (such as impersonating banks and promising free services), to screen potential clients.

3) Trade secret infringement: an engineer used their position to privately download complete code containing core data algorithm technology (exceeding15GB) from their employer, intending to misappropriate it. The code was identified as trade secret; the engineer was ordered to cease the illegal conduct and fined RMB 360,000.
