Recently, at the domestic governance level, the Sanya Cyberspace Administration interviewed and ordered rectification of an enterprise that provided algorithm recommendation services without completing filing procedures. This is the first publicly disclosed case for failing to fulfill algorithm filing obligations, serving as a warning for enterprises to timely fulfill algorithm filing obligations and assume primary responsibility for algorithm security in accordance with the law; Multiple departments including the Ministry of State Security, the MIIT, and CNCERT have issued security risk alerts and deployment/usage recommendations targeting OpenClaw; in terms of promoting data utilization, the NDA has released multiple policy interpretations on data utilization and data property rights, providing scenario-based explanations of the basic concept of the "three-rights separation" system and right allocation in special scenarios. Internationally, the European Commission has released the the second draft of the Code of Practice on Labeling AI-Generated Content, and continues discussions on revisions to the AI Act; the Luxembourg Administrative Court has revoked the fine in Amazon's GDPR violation case; the U.S. COPPA 2.0 has been passed by the Federal Senate; Brazil and South Korea have revised their respective data protection laws.

NDA Publishes Multiple Policy Interpretations on Data Utilization and Data Property Rights


Recently, the National Data Administration (NDA) has released multiple policy interpretations, explaining specific scenarios around the structural separation of data property rights, the arrangement of data property rights allocation, the allocation of property rights in entrusted data processing, the collection of public data by automated programs, and the allocation of property rights in the integrated utilization of multiple data sets. This series of policy interpretations first clarifies concepts such as data ownership, usage rights, operational rights, data processors, and information subjects, and also specifies: 1) the rule that the "three rights" of data are not transferred to the trustee in entrusted data processing; 2) four compliance consensuses for collecting public data through crawlers and other methods—collectors may own and use legally collected data, and operate innovatively developed data products on the premise of not substantially replacing the collector's products and services; 3) the allocation of property rights in the cooperative development of integrated utilization of multiple data sets shall be based on agreement first; in the absence of an agreement, the provisions on co-ownership in the Civil Code may be referred to, where all parties shall have ownership and usage rights, and operational rights with the consent of other parties.

Multiple Government Agencies Issue OpenClaw Security Advisories


Recently, China's Ministry of Industry and Information Technology, the Ministry of State Security, the National Cybersecurity Alert Center, and the National Computer Network Emergency Response Coordination Center have issued multiple safety usage and risk alerts concerning "OpenClaw." These series of risk alerts: 1) summarize the significant risk scenarios and items currently involved in the deployment of OpenClaw, including but not limited to supply chain attacks and enterprise intranet penetration risks, leakage and hijacking of system device sensitive information, theft of personal information and leakage of sensitive data, and risks of erroneous transactions or even account takeover; 2) provide security measures and risk prevention recommendations corresponding to these risk scenarios and items.
