The Ministry of Public Security Issues the Measures for the Supervision and Inspection of Cyberspace Security by Public Security Authorities

On August 6, 2026, the Ministry of Public Security issued the Measures for the Supervision and Inspection of Cyberspace Security by Public Security Authorities (hereinafter the "Measures"), which will take effect on October 1, 2026, simultaneously repealing the 2018 Provisions on the Supervision and Inspection of Internet Security by Public Security Authorities. The key changes introduced by the Measures include: first, the regulatory scope has been broadened from "internet security" to "cyberspace security," with inspection targets expanded from internet service providers and network-using entities to encompass the full chain of actors, including network operators, data processors, personal information processors, and providers of network products and services; second, building upon traditional inspection items such as record-filing, classified protection, log retention, and technical safeguards, new items have been added covering data security, personal information protection, and algorithm security; third, a parallel inspection mechanism combining online patrols, remote testing, and on-site inspections has been established, with an emphasis on inter-agency coordination and the reuse of inspection results; and fourth, a progressive enforcement mechanism has been formed, escalating from warnings and notifications to regulatory interviews and legal accountability. Relevant enterprises are advised to review their obligations against the Measures, prepare inspection materials in advance, and establish a closed-loop compliance mechanism.

Cyberspace Administration of China Seeks Public Comments on the Measures on Personal Information Protection by Large-scale Personal Information Processors (Draft for Public Comment)

On August 7, 2026, the Cyberspace Administration of China (CAC) issued the Measures on Personal Information Protection by Large-scale Personal Information Processors (Draft for Public Comment) (hereinafter referred to as the "Measures"), launching a public consultation. Comments will be accepted until September 7, 2026.

Building upon existing rules governing personal information protection for large online platforms, the Measures consolidate and refine relevant provisions, expanding its scope of application from "large online platforms" to "large-scale personal information processors" Overall, the Measures intend to impose stricter compliance requirements on entities that process personal information on a large scale, operate diverse business lines and wield substantial social influence. Key mechanisms covered include structured notification, automated decision-making, cross-border transfer of personal information, PIA filing, personal information protection officers, supervision committees, compliance audits, risk assessment and social responsibility reports. This signals that regulation is further evolving from "paper compliance" to "systematic governance”.
