Recently, in AI governance, the Ministry of Commerce and the Ministry of Science and Technology solicited public comments on proposed additions to the technology export catalogue, including multiple AI-related technologies; a Hubei court concluded the province's first copyright dispute involving an AI-generated short drama; and the appeal judgment was delivered in Shanghai's first AI-generated voice infringement case. In legislation and policy, the CPC Central Committee and the State Council issued the Opinions on Developing New Quality Productive Forces, while the People's Bank of China sought comments on new rules for the financial credit information database. In regulatory enforcement, the Ministry of Industry and Information Technology and local regulators continued to publish notices concerning apps infringing users' rights, and public security cyber authorities advanced the Clean Cyberspace campaign. Overseas, the European Commission updated its explanation of the AI Act enforcement framework and consulted on a draft implementing regulation governing AI Act enforcement procedures; the U.S. Senate passed the Healthcare Cybersecurity and Resiliency Act; a settlement was reached in the Google Assistant privacy class action; the Texas Attorney General settled with Temu over data protection and product safety; and the FTC launched investigations involving OpenAI and Anthropic, among other developments.

The Ministry of Commerce and the Ministry of Science and Technology Seek Public Comments on the Catalogue of Technologies Prohibited or Restricted from Export by China and Introduce Interim Registration Requirements for Related Technology Exports

On October 16, 2026, the Ministry of Commerce and the Ministry of Science and Technology issued Announcement No. 48 of 2026, inviting public comments on revisions to the Catalogue of Technologies Prohibited or Restricted from Export by China (the “Catalogue”) and simultaneously introducing pre-export registration requirements for the relevant technologies.

The proposed revision would add 40 technologies across three sectors: artificial intelligence, biomedicine and photovoltaics. Of these, 23 AI-related technologies cover large models, AI agents, computing clusters and information processing, while expressly excluding technologies that have entered the public domain through open-source release, academic publication or similar means. Five biomedical technologies cover cell and gene therapy, small nucleic acid drugs and pathogenic microorganisms; facilitation measures such as automatic licensing would apply to certain outbound licensing arrangements that do not transfer ownership. Twelve photovoltaic technologies cover polysilicon, wafer and cell manufacturing, and the regulated scope also encompasses critical and core equipment embodying the relevant technologies.

These revisions to the Catalogue constitute a significant adjustment to China's technology export control regime by the Ministry of Commerce and the Ministry of Science and Technology under the Foreign Trade Law of the People's Republic of China and the Regulations of the People's Republic of China on the Administration of Technology Import and Export. They mark a move towards more granular controls over technology exports in competitive sectors such as AI, biomedicine and photovoltaics. The simultaneous introduction of pre-export registration means that, from the announcement's issuance until the revised Catalogue formally takes effect, enterprises exporting these technologies must complete registration procedures, reflecting regulators' particular concern about risks of advanced technology transfers abroad.

The European Commission Updates Its AI Act Enforcement Framework Explanation, Clarifying Enforcement Powers and Phased Application

On October 6, 2026, the European Commission updated its webpage explaining the enforcement framework for the Artificial Intelligence Act (AI Act), outlining the division of responsibilities among the European AI Office (AI Office), the European Data Protection Supervisor (EDPS), and regulators designated by Member States. The AI Office oversees general-purpose AI (GPAI) models and certain AI systems and has investigative and sanctioning powers. The EDPS supervises compliance by AI systems used by EU institutions, while national regulators enforce rules applicable to other AI systems. The explanation also reiterates the AI Act's phased application schedule.
