Ministry of Commerce Seeks Public Comments on the Special Provisions on the Protection of Chinese Trade Secrets (Draft for Comments)

On October 26, 2026, the Ministry of Commerce (MOFCOM) released the Special Provisions on the Protection of Chinese Trade Secrets (Draft for Comments) (the “Draft Provisions”) for public comment, with a deadline of November 24. Comprising ten articles, the Draft Provisions propose a special response mechanism addressing foreign entities’ misappropriation of Chinese trade secrets in international economic and trade activities and related activities, where such conduct harms, or poses a real threat to, China’s national sovereignty, security or development interests.

Under the Draft Provisions, MOFCOM may impose restrictions on imports and exports of goods and technology and international trade in services, restrict new investment in China and the entry of relevant personnel, and impose fines. The Draft Provisions also provide procedures for investigations and representations, adjustment of measures, and exemptions for special transactions.

State Administration for Market Regulation Approves Two Mandatory National Standards on Intelligent Connected Vehicle Data Security

On September 28, 2026, the State Administration for Market Regulation (SAMR) and the Standardization Administration of China (SAC) issued GB 48319—2026, Basic requirements of security processing for intelligent and connected vehicle spatio-temporal data, and GB 48320—2026, Basic security requirements for spatio-temporal data sensing system of intelligent and connected vehicle. Both are mandatory national standards taking effect on October 1, 2027, subject to phased implementation arrangements.

The former standard classifies spatiotemporal data into five categories—trajectory, point cloud, imagery, inertial navigation and mapping data—and regulates the names and attributes of sensitive targets, confidentiality processing of geographic information, limits on road coverage by point cloud, trajectory-associated imagery and mapping data (no more than 10 consecutive kilometres or 350 kilometres cumulatively for in-vehicle storage, and no more than 10 consecutive kilometres for any single out-of-vehicle transmission), and the requirement for domestic transmission destinations. The latter standard regulates confidentiality-processing functions, collection accuracy, storage access controls, transmission security, testing and determinations of whether sensing systems are of the same type.
